REQUEST: Utility Department Requesting Authorization to Execute Amendment 67 for
Consulting Engineering Services with Conklin, Porter & Holmes Engineers, Inc.
PURPOSE: The purpose ofthis Board item is to request authorization for the execution of
Amendment 67 for the Design of Well #4, Raw Water Piping and associated Water
Distribution Piping for WTP #1 with Conklin, Porter & Holmes Engineers, Inc. at a
cost of $22,760.00.
CONSIDERATIONS:
This amendment is needed to design well #4, raw water piping, and distribution
extension at WTP #1 on Northern Way. The addition of the well has been anticipated and
previously permitted with the St. Johns River Water Management District to meet projected
water supply demands. The well is proposed to be installed on Utility property (Tract C of
Tuscawilla Unit 8) near the intersection of Tuskawilla Road and the FP&L easement. A test
well was constructed at this location last year with good water quality results.

The scope of work includes design and permitting of a 12" well, raw water piping back
to WTP #1, and distribution piping from WTP#l to Tuskawilla Road. The distribution piping
will connect the new 12" main currently being installed on Tuskawilla Road to enhance
distribution system pressures. The cost for the design scope of work is $22,760. The
estimated construction cost is $325,000,
FUNDING:
The funding source for this project expenditure of $22,760.00 is the capital
improvement line code of the Utility Enterprise 1997 Construction Fund - (#3630-56310),
The funds for this project will be expended over the next 120 days.
RECOMMENDA TION:
It is recommended that authorization be given for the execution of Amendment
67 for the Design of Well #4, Raw Water Piping and associated Water Distribution
Piping for WTP #1 with Conklin, Porter & Holmes Engineers, Inc. at a cost of
$22,760.00 payabIe from the capital improvements line code of the Utility Enterprise
1997 Construction Fund - (#3630-56310).
IMPLEMENTATION SCHEDULE:
The scope of services will be completed within 120 days of approval.

This Amendment dated , 2000, by and between the City of Winter Springs
(hereinafter called the OWNER) and CPH Engineers, Inc, (hereinafter called the Engineer),
is mutually agreed upon and declared an authorized Amendment to an Agreement dated
November 27, 1984, between the parties, herein setting forth the scope, terms and
conditions of the services herein authorized. The appropriate provisions of the Agreement
apply as fully as if repeated herein.
SECTION 1
GENERAL
1.1
The purpose of this Amendment is to provide for Engineering Services, more
specifically itemized herein, in the preparation of Plans and Specifications for
the construction of Well No.4, a raw water main connection to WTP 1 and
water main extension from WTP 1 to Tuscawilla Road.
SECTION 2
BASIC SERVICES OF THE ENGINEER
2.1 GENERAL
2.1.1 The ENGINEER agrees to perform professional services in connection with
the project as hereinafter stated.
2.1.2 The ENGINEER will serve as the OWNER'S professional engineering
representative in those phases of the project to which this Amendment
applies, and will give consultation and advice to the OWNER during the
performance of his services. The ENGINEER will perform t~e services for
the City Commission under the general supervision of the City Manager and
Utilities Director and will submit interim plans to them for their review, input,
decision, etc. as appropriate.
SECTION 3
SCOPE OF SERVICES
3.1
GENERAL
The OWNER hereby authorizes the ENGINEER to proceed with the
preparation of plans and specifications for Well NO.4 and the water main
extension as listed below. No wetlands or environmental services are
anticipated for this project. No survey will be obtained and no soils work will
be provided. The plans will be based on available CAD map data.
3.1.1 Location
Well No.4 will be placed at the northeast quadfant of Tuscawilla Road and
the Power Easement.

WELL NO.4 and RAW WATER LINE DESIGN
Review data obtained from the test well.
Discuss with SJRWMD the potential well capacity and possible limitations on
withdrawal for this new well. We understand that Winter Springs is an area
of concern for well locations and saltwater upconing. We recommend a
minimum 12-inch diameter well for Well No.4, which will allow the City more
options'if the well performs better than expected,
Discuss project with SJRWMD and determine current requirements for the
design as well as the testing required to place the well into service. Include
these items into the Contract Documents. Provide documents to SJRWMD
for review.
Review current FDEP Regulations and discuss project with FDEP and
determine current design and testing requirements for wells and incorporate
these items into the Contract Documents.
Prepare drawings and specifications for the well construction based on
current regulations and connection to the existing WTP1 via a 12-inch raw
water line.
Retain the services of an electrical subconsultant to review the existing MCC,
the existing controls, the slot available for the starter for Well No, 4, the
wiring to Well No.4, and to design the electrical items required at the well
head.
We recommend that the line be a minimum 12-inch diameter. It shall be C-
900 because it is in a power easement that can be traveled by heavy service
trucks. The line needs to be non-conductive and, therefore, PVC, The line
shall be marked "Raw Water". The route is approximately 200.0 lineal feet.
Since there are no storm facilities or other utilities in the power easement
(forcemain excepted), the drawings will not include a profile view.
DESIGN WATER MAIN EXTENSION
Provide a 16-inch PVC water main design from the downstream side of the
plant meter to Tuscawilla Road following the power easement alignment,
approximately 2200 lineal feet. Utilize existing city map for this design. No
survey will be acquired.
Design connections at both locations.
The raw water line and the potable lines shall have ten feet of horizontal
separation in accordance with FDEP regulations.
3.3.4 Since there are no storm facilities or other utilities in the power easement
(forcemain excepted), the drawings will not include a profile view.
3.4 BIDDING SERVICES FOR WELL CONSTRUCTION AND WATER MAIN
EXTENSION
The ENGINEER will provide these services after separate authorization and
Notice to Proceed from the OWNER. We envision two bids; one for the well
and the othe~ for the raw and distribution system improvements.
3.4.1 Prepare advertisement for bid for placement in appropriate publications by
the OWNER.
3.4.2 Distribute and keep records of the distribution of documents to bidders and
supplie.rs.
3.4.3 Issue addenda to the documents as required.
3.4.4 Answer questions of bidders and suppliers. No interpretations of the
documents shall be made other than through issuance of addenda to the
documents.
3.4.5 Attend the bid opening and OWNER'S meetings at which time bids are to be
opened and contracts awarded.
3.4.6 Evaluate the bids and assist the OWNER in the selection of the construction
contractor.
3.4.7 Consult with the OWNER and participate in all decisions as to ?cceptability
of subcontractors, other persons, and organizations proposed by the general
contractor for these portions of the work for which subcontractor approval is
required by the documents.
3.4.8 Prepare and review contracts, bonds, insurance certificates, construction
schedules and other portions of the Contracts in order to assist the OWNER
in his determination as to whether to issue a Notice to Proceed to the
Contractor.
3.5 FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION PERMIT -
WELL NO.4 AND RAW WATER LINE
To connect the well to WTP1, a construction permit application will be
required. This application is made after the well has been constructed and
tested (water quality and disinfection testing). This can be considered as
Part Two of the project. However, the documents will be prepared during
well design and construction and be ready for submittal upon completion of
the well.
3.5.1 Prepare a preliminary engineering report that identifies the capacity of each
plant component for submittal to FDEP. Also include well data on the new
Well No.4, such as water quality, disinfection, and capacity for their review.
Sampling will be provided by the well contractor.
3.5.2 Prepare a construction permit application for execution and submittal by the
City.

3.5.3 Submit plans and specifications for connection to the existing 12-inch raw
water line with the permit application for review and approval.
3.5.4 Respond to FDEP comments.
3.6 FDEP PERMIT - DISTRIBUTION LINE
3.6.1 Prepare a construction permit application for the 16-inch water line
connecting to WTP1 to the water main on Tuscawilla Road for execution and
submittal by the City.
3.6.2 Submit plans and specifications.
3.6.3 Respond to FDEP comments.
3.7 POWER EASEMENT- ROW UTILIZATION PERMIT
3.7.1 Prepare the paperwork necessary to obtain a ROW utilization permit from the
power company.
3.7.2 Identify the location of poles and their 10 #.
SECTION 4
SUPPLEMENTARY SERVICES OF THE ENGINEER
4.1 If authorized in writing by the OWNER prior to the rendering of such services,
the ENGINEER will furnish or obtain under subcontracts, supplementary
services of the following types which will be paid for by the OWNER as
described in SECTION 6, Paragraph 6.1.2,
4.2.1 Additional services due to significant changes in the scope of the project or
its design including, but not limited to, changes in size, complexity, character
of construction or due to time delays in initiating or completion of the work as
described herein.
4.2.2 Additional services in connection with the project including services normally
furnished by the OWNER as described in Section 5 herein and services not
otherwise provided for in this Amendment.
4.2.3 Preparing to serve and serving as an expert witness for the OWNER in any
protest, litigation, or other proceeding involving the project.
4.2.4 Additional engineering services required by revisions to regulations (after the
date of this Amendment) as applicable to the Florida Department of
Environmental Protection, the St. Johns RiverWater Management District, or
other regulatory agency requirements.
4.2.5 Provide, through a subconsultant, additional surveying services if required or
requested by the OWNER.
4.2.6 Provide, through a subconsultant, soils investigation and geohydrological
services if required or requested by the OWNER, or if required by SJRWMD
or FDEP, recommended by the ENGINEER and authorized by the OWNER.
SECTION 5
THE OWNER'S RESPONSIBILITIES
5.1 The OWNER will:
5.1.1 Advise the ENGINEER of his requirements for the project and designate a
person to act as the OWNER'S representative with respect to the work to be
performed under this Amendment, and such person shall have complete
authority to transmit instructions, receive information, interpret and define the
OWNER'S policies and decisions pertinent to the work covered by this
Amendment.
5.1.2 Guarantee access to and make all provision for the ENGINEER to enter
upon public and private lands as required for the ENGINEER to perform his
work under this Amendment.
5.1.3 Provide data requested that is reasonably available on the existing utility
systems, population and projections, land use and planning information.

Provide personnel to locate facilities and mow, trim, or otherwise make them
accessible for inspection.
Examine all studies, reports, sketches, and other documents presented by
the ENGINEER and render decisions pertaining thereto within a reasonable
time so as not to delay the work of the ENGINEER.
Obtain approval of all governmental authorities having jurisdiction over the
project, and such approvals and consents from such other individuals or
bodies as may be necessary for completion of the Project.
Furnish, or direct the ENGINEER in writing to provide at the OWNER'S
expense, soils investigations if advised in writing by the ENGI~EER that they
are necessary or advisable.
Furnish, or direct the ENGINEER in writing to provide at the OWNER'S
expense, necessary additional services as stipulated' in Section 4 of this
Amendment, or other services as required.
Provide such legal, accounting, and insurance counseling services as may
be required for the project, and such auditing services as the OWNER may
require.
Give prompt written notice to the ENGINEER whenever the OWNER
observes or otherwise becomes aware of any defect in the Project.
SECTION 6
PAYMENT
PAYMENT
Payments for services and expenses of the ENGINEER to be as, set forth
below:
6.1.1 Principals and Employees of the ENGINEER.
6.1.2 The fee for the scope of services described herein will be provided for a lump
sum fee of $22",760, including bidding services. No inspection or construction
administration services are included in this fee. A breakdown is included in
Attachment A.
6.2 REIMBURSED EXPENSES
6.2,1 The OWNER will make prompt monthly payments in response to
ENGINEER'S monthly statements vlithout retention fOf all categories of
services rendered under this Amendment and for reimbursable expenses
incurred.
6.2.2 Charges for the services rendered by principals and employees as witnesses
in any litigation, hearing or proceeding in accordance with Paragraph 4.1.3
will be computed at a rate of $650.00 per day or any portion thereof (but
compensation for time spent in preparing to appear in any such litigation,
hearing or proceeding will be computed on an hourly rate).
6.2.3 If this Amendment is terminated during prosecution of the services prior to
completion of the services of Section 3, payments to be made in accordance
with Paragraph 6.1.1 and 6.2.1 on account of that and all prior work under
this Amendment shall be due and payable, and shall constitute total payment
for services rendered. In addition, upon termination, the ENGINEER shall
be paid for any Additional Services authorized and rendered under Section 4.
6.2.4 The ENGINEER shall promptly begin work on the services authorized by this
Amendment upon receipt of notice to proceed from the OWNER.
SECTION 7
GENERAL CONDITIONS
7.1
Since the ENGINEER has no control over the cost of labor, materials, or
equipment, or over any construction contractor's method of determining
prices, any opinions of probable construction cost which may be provided in
the services of this Amendment are made on the basis of his experience and
qualifications and represent his best judgement as a design professional
familiar with the construction industry, but the ENGINEER cannot and does
not guarantee that bids or the construction cost will not vary from opinions of
probable cost prepared by him.
7.2
The OWNER and the ENGINEER each binds himself and his partners,
successors, executors, administrators and assigns to the other party of this
Amendment and to partners, successors, executors, administrators, and
assigns of such other party in respect to all covenants of this Amendment.
Nothing herein shall be construed as creating any personal liability on the
part of any officer or agency of any public body, which may be a party hereto, .
nor shall it be construed as giving any rights or benefits hereunder to anyone
other than the OWNER and the ENGINEER.
SECTION 8
8.1
The ENGINEER agrees to prosecute the work in a timely manner until the
Project is completed.

sum fee of $22,760, including bidding services. No inspection or construction
administration services are included in this fee. A breakdown is included in
Attachment A.

6.2 REIMBURSED EXPENSES
6.2.1 The OWNER will make prompt monthly payments in response to
ENGINEER'S monthly statements without retention for all categories of
services rendered under this Amendment and for reimbursable expenses
incurred.
6.2.2 Charges for the services rendered by principals and employees as witnesses
in any litigation, hearing or proceeding in accordance with Paragraph 4.1.3
will be computed at a rate of $650.00 per day or any portion thereof (but
compensation for time spent in preparing to appear in any such litigation,
hearing or proceeding will be computed on an hourly rate).
6.2.3 If this Amendment is terminated during prosecution of the services prior to
completion of the services of Section 3, payments to be made in accordance
with Paragraph 6.1.1 and 6.2.1 on account of that and all prior work under
this Amendment shall be due and payable, and shall constitute total payment
for services rendered. In addition, upon termination, the ENGINEER shall
be paid for any Additional Services authorized and rendered under Section 4.
6.2.4 The ENGINEER shall promptly begin work on the services authorized by this
Amendment upon receipt of notice to proceed from the OWNER.
SECTION 7
GENERAL CONDITIONS
7.1 Since the ENGINEER has no control over the cost of labor, materials, or
equipment, or over any construction contractor's method of determining
prices, any opinions of probable construction cost which may be provided in
the services of this Amendment are made on the basis of his experience and
qualifications and represent his best judgement as a design professional
familiar with the construction industry, but the ENGINEER cannot and does
not guarantee that bids or the construction cost will not vary from opinions of
probable cost prepared by him.
7.2 The OWNER and the ENGINEER each binds himself and his partners,
successors, executors, administrators and assigns to the other party of this
Amendment and to partners, successors, executors, administrators, and
assigns of such other party in respect to all covenants of this Amendment.
Nothing herein shall be construed as creating any personal liability on the
part of any officer or agency of any public body, which may be a party hereto,
nor shall it be construed as giving any rights or benefits hereunder to anyone
other than the OWNER and the ENGINEER.

SECTION 8
The ENGINEER agrees to prosecute the work in a timely manner until the
Project is completed.
