PURPOSE: The purppse of this Board item is to request authorization to Execute Supplement 1 to Amendment 72 - Construction Administration Services for Town Center Streetscape with CPR Engineers, Inc. at a cost of $26,775.00. CONSIDERA TIONS: This supplement is needed to provide construction administration services for the Town Center streetscape construction project. The project includes sidewalks, landscaping, irrigation, and fountains and pavers at Market square and Magnolia Park. The scope and complexity of this project coupled with current vacancies and reductions in City technical staff necessitates the use of a consultant to provide adequate project oversight. The scope of work includes preconstruction coordination, daily inspections, shop drawing approval, change order preparation, regulatory certifications and construction administration. The general contractor is Gel/General Constructors, Inc of Altamonte Springs with a contract value of$781,795.37 and construction contract period of240 days. This represents approximately 3.5% of the overall project cost which is well below industry standards. May 12, 2003 Consent Agenda Item D Page 2 FUNDING: The funding source for this project expenditure of $26,775 is the 2002-2012 One-Cent Sales Tax Renewal from Seminole County. The funds for this project will be expended over the next 240 days. RECOMMENDA TION: It is recommended that authorization be given to execute Supplement 1 to Amendment 72 - Construction Administration Services for the Town Center Streetscape Project with Conklin, Porter & Holmes Engineers, Inc. at a cost of $26,775.00 payable from the One-Cent Sales Tax Renewal Funds from Seminole County. IMPLEMENTATION SCHEDULE: The scope of services will be completed within 240 days of approval. ATTACHMENTS: 1. This Amend'ment dated fItr',/ ~ ,2003, by and between the City of Winter Springs (hereinafter called the 0 ER) and CPH Engineers, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Supplement to Amendment 72, between the parties, herein setting forth the scope, t~rms and conditions of the services herein authorized. The appropriate provisions of the Agreement apply as fully as if repeated herein. WHEREAS, the OWNER and the ENGINEER have previously entered into an Agreement for the ENGINEER'S professional services for Design SerVices (Amendment 72); and WHEREAS, Amendment 72 has been approved, authorized by the Commission, and signed by the OWNER; and WHEREAS, additional services are required for construction administration services along Hickory and along Tuskawilla; and WHEREAS, the OWNER and the ENGINEER now wish to modify and add specific items to Amendment 72; NOW THEREFORE, in consideration of the mutual promises and covenants contained herein and given one to the other the sufficiency of which is hereby acknowledged, the parties agree as follows: I. SCOPE OF WORK The scope of work shall be for construction administration services for the Winter Springs Streetscapes. II. FEE The fee and detailed plan of study is attached hereto and incorporated herein, by reference, as Exhibit 1. III. ENTIRE AGREEMENT This Supplement No. 1 to Amendment 72 supersedes all previous authorizations, agreements, or representations, either verbal or written, heretofore in effect between the OWNER and the ENGINEER that may have concerned the matters covered herein, except that this Supplement shall in no way supersede or amend Amendment 72 or other authorizations except as specifically provided herein. No additions, alterations, or variations to the terms of this Supplement shall be valid, nor can the provisions of this Supplement be waived by either party, unless such additions, alterations, or waivers are expressly set forth .in writing in a document of import equal to Amendment 72 or the Supplement and duly executed. IV. TIME OF COMPLETION This Supplement will be completed within the construction schedule timeframes.
