Authorization REQUEST: Public Works Department / Stormwater Division Requesting City Commission Approval to execute Amendment No.1 to the Project Agreement between the City and the United States Department of Agriculture - Natural Resources Conservation Service (USDA - NRCS) on the Funding Assistance for the Emergency Watershed Protection Program (EWP). PURPOSE: The purpose of this agenda item is to request authorization to execute Amendment No. 1 to the project agreement between the City and the USDA - NRCS on the funding assistance for the Emergency Watershed Protection Program (EWP) projects. Amendment No.1 extends the completion time of the project agreement by two months to November 30,2005. CONSIDERATIONS: · On December 17, 2004, the City Commission approved a project agreement between the City and the Natural Resources Conservation Service (NRCS) through its Emergency Watershed Protection Program that allocates funding for projects of this type created by natural disasters like the hurricanes of 2004. · Under the City's agreement with NRCS, funding was allocated for eligible City and private property projects with the provision of seventy five percent (75%) of the construction cost of each project from NRCS. The City or private property owners / entities are responsible for twenty five percent (25%) of the cost of each project in the form of cash or in-kind services. · To-date, the City has entered into constructi6ncontracts for three (3) projects under the NRCS agreement, with the status of each as follows: (1) Clearing of the Creeks and Canals - 100 % complete (2) North Tuskawilla Road Stormwater Improvements - 85 % complete Consent Agenda Item 201 September 26, 2005 Page 2 (3) Erosion Control and Howell Creek Bank Stabilization at Chelsea Parc subdivision - 80 % complete Projects (2) and (3) are scheduled to be 100 % complete by September 30,2005. . Amendment No. 1 ofthe project agreement provides a new time completion from September 30,2005 to November 30,2005. . With approval of Amendment NO.1 and the remaining allocated funds under the project agreement, City staff is pursuing another erosion control project at Hacienda Village. Staff has been informed that the Board of Directors of Hacienda Village Cooperative is willing to provide the twenty five percent (25%) cost share. If Amendment NO.1 is approved, Staff expects the construction agreement for the Hacienda Village project to be presented for the City Commission's approval at the October 10, 2005 Commission meeting. FUNDING: Amendment NO.1 is two-month time extension to the current agreement and has no funding changes. RECOMMENDATION: It is recommended that authorization be given to execute Amendment NO.1 to the Project Agreement between the City and the Natural Resources Conservation Service. IMPLEMENTATION SCHEDULE: Upon signing of Amendment No. 1 to the project agreement, the completion time of all City projects with NRCS funding is extended to November 30,2005. ATTACHMENTS: 1. I To PROJECT AGREEMENT 69-4209-5-1650 Between CITY OF WINTER SPRINGS And The UNITED STATES DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE RE: Emergency Watershed Protection project resulting from Hurricane Jeanne. This amends the Project Agreement 69-4209-5-1650 between the above parties relative to the Hurricane Jeanne Emergency Watershed Protection Project. Clause B.I is amended to extend the completion time and to read as follows: 1. Provide for the accomplishment of the works of improvement described in Section A and provide for completion by November 30, 2005. The Sponsor will provide NRCS a copy of any solicitation (Invitation for Bids, Request for Quotations, etc.), bid abstract, awarded contract, or other basis of cost and accomplishment. All other provisions of the Agreement remain unchanged.
