The Contract for Sale and Pwchase dated MARCH 14, 2006 is hereby extended and amended to comply with the to o e HUD-1 Closing Statement and Closing documents. The closing date has been extended to ~i~, 2006. The cl sing costs and epostts, credits and items as shown on the I-iiJD-1 Settlement Statement dated ~ day of~, 2006 are true and correct and have been agreed upon including those to the Buyer and Sellers. Costs as shown on the Contract are hereby amended to agree with the HUD-1 Settlement Statement. We waive ow rights per RESPA regulations to view the HUD-1 Settlement Statement 24 hours prior to closing. Any unused or unexpended costs or fees may be retained by the closing agent as administrative fees. 2. All contingencies of the agreement have been complied with or are waived and there are no further agreements to be performed between the parties or by the real estate agents or brokers or to be performed or prepazed by Harry G. Reid, III, Closing Agent, or brokers except that closing is contingent upon clearance of funds supplied Harry G. Reid, III by the parties and/or the lenders, if any. 3. That Harry G. Reid, III is acting as closing agent and is issuing the title insurance and does not represent either party, and is not the attorney or agent for the Buyer or Seller, except as is shown on Agreement for Providing of Settlement Services by Harry G. Reid, III. Buyers and Sellers are advised to retain their own attorney to represent them at closing and to review and advise on this addendum and all closing documentation. 4. Parties acknowledge that all required or agreed upon repairs, if any, have been satisfactorily completed or settled betwcen the parties outside of closing and that the closing agent, lender, realtors and brokers are not responsible for any repairs or for the collecting or payment of same. Buyer(s) has/have examined the survey and inspection reports, if any, has checked with the appropriate governmental authorities for code compliance and permits and lien checks or has/have waived same and has performed al] inspections and inquiries or have waived same is satisfied with the elevation and condition of the property, satisfied with the property's suitability for Buyer's purpose and is accepting the property, both real and personal, in as is condition. 5. Buyer and Seller agree that in the event any creditor receiving a payoff as set forth in the HUD-1 Settlement Statement refuses to accept the amount tendered, the party who is obligated to make such payoffs shall immediately after demand pay to the Settlement Agent sufficient additional funds to satisfy the creditor. 6: We instruct Harry G. Reid, III to disburse all funds based upon the HUD-1 Closing Statement of even date and hereby indemnify and hold him and the real estate agents and real estate brokers harmless from any claims or actions arising out of or related to the above and his closing and immediate disbursement of the above transaction. ADDENDUM TO HUD-1 SETTLEMENT STATEMENT: The undersigned have carefully reviewed the HUD-1 Settlement Statement and to the best of their knowledge and belief, it is a true and accurate statement of all receipts and disbursements made on their account or by them in this transaction. They fiirther certify that they have received a copy of the HUD-1 Settlement Statement. These provisions shall survive closing.
