Authorization REQUEST: Utility Department Requesting Authorization to enter into a Contractual Agreement for a Lift Station Model, Analysis and Design for the Western Wastewater Transmission System. PURPOSE: The purpose of this Board item is to request authorization to enter into a contractual agreement with CPH Engineers, Inc. of Orlando, Florida for the design of a SewerCad Lift Station Model, Analysis and Design for the Western Wastewater Transmission System at a cost of$39,965.00 CONSIDERATIONS: This project is needed for the efficient design of wastewater transmission system serving the area from approximately Tuskawilla Road westward. It will develop a computer aided model and electronic simulation of the flow of the current system in a 24 hour period. This computer model will then be compared to the information the Utility Department as to check for accuracy. After completion of the current system, CPH Engineers will also prepare a model for the extension of the system on Moss Road and prepare design and construction plans for this extension based on the findings of the model. Additionally CPH Engineers will report any recommended improvements to the overall Western Transmission System as it relates to the entire system and specifically as it relates to expansion of the Town Center System. In addition to the Moss Road force June 12,2006 Consent Agenda Item 405 Page 2 main design, the findings of this report will allow the Utility Department to develop a Capital Improvement Plan should the report find any deficiencies in the system. FUNDING: The proposed agreement amount of $39,965.00 is budgeted in the $150,000 from fund 3600-62100 West Force Main Re-Routing Project which will only be in design this fiscal year. RECOMMENDATION: It is recommended that authorization be granted to enter into a contractual Agreement with CPH Engineers, Inc. of Orlando, Florida for the Western WRF Lift Station Analysis and Design at a cost of $39,365.00 which is payable from the Water and Sewer Department Operating Expenditures line code 3600-62100. Amendment 86 For Western WRF Lift Station Analysis and Design COMMISSION ACTION: Attachment No.1 AMENDMENT 86 FOR WESTERN WRF LIFT STATION And TRANSMISSION SYSTEM ANALYSIS and DESIGN BETWEEN THE CITY OF WINTER SPRINGS AND CPH ENGINEERS, INC. This Amendment dated , 2006, by and between the City of Winter Springs (hereinafter called the OWNER) and CPH Engineers, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Amendment to an Agreement dated November 27, 1984, between the parties, herein setting forth the scope, terms and conditions of the services herein authorized. The appropriate provisions of the Agreement apply as fully as if repeated herein. SECTION 1 GENERAL 1.1 The purpose of this Amendment is to provide for Engineering Services, more specifically itemized herein, in the preparation of a SewerCad model of the western lift station system not including the Highlands area system (the excluded lift stations include 3W, 4W, 6W, 9W and 13 W). The plant lift station, 12W, will be included as it connects to the system in question. SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. 2.1.2 The ENGINEER will serve as the OWNER'S professional engineering representative in those phases of the project to which this Amendment applies, and will give consultation and advice to the OWNER during the performance of his services. The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager and Utilities Director and will submit interim plans to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the preparation of the model and analysis. 3.2 Model and Analysis 3.2.1 The City shall provide an AutoCad or electronic compatible version of the sewerage transmission system for import into the SewerCad program. This system shall also contain any known, designed or planned improvements and if not, they shall be identified by the City for inclusion in the analysis. 3.2.2 The City shall provide all pertinent data and lift station pump curves. This includes: 1) Number of pumps per station 2) Wet well diameter 3) Variable speed pumps and locations 4) Size, type and brand of each pump at each associated lift station and a pump curve for each pump 5) Forcemain and gravity system sizes. The gravity size only applies to gravity sections required for re-pump situations, such as the Town Center system to the LS10W system. For these gravity sections that receive a lift station discharge and the flow continues on to another lift station (re-pump), we need to have the invert elevations at each manhole or at least the total drop and total length from the initial discharge manhole to the lift station 6) Pump station run times 7) Pump station draw-down results 8) Float elevations at each lift station 9) Relative elevations (based on USGS datum) of the top and bottom of the lift stations (these can be obtained form record drawings and do not need to be surveyed unless the City wants that degree of accuracy) 3.2.3 The City shall provide the average annual daily per capita flow and the average persons per household or the average daily flow per customer/connection. 3.2.4 The City shall identify and provide the lift station basin areas. 3.2.5 The City shall provide the number of single family and multi family units and commercial flows in each lift station basin. 3.2.6 CPH will prepare a model using SewerCad using the data obtained from the above items. Run a 24 hour simulation of the system and verify with the City that the model mimics the actual system. Analysis will include and evaluation of future conditions with information provided by the city. 3.2.7 CPH will analyze the extension of the forcemain from LS 10W, 5W and 11W and the elimination of the gravity section on Moss Road. Within this scenario is the assumption that lift stations 10W, 5W and 11W will pump sewage directly to the West WRF and that the forcemain will be extended to the west side of LS 7W. We will provide the City with the system capital improvements necessary to meet these conditions. We will also analyze any weaknesses in the existing systems and advise the City if we believe that any additional capacity is available within the system. Of particular interest is the Town Center/High School system which pumps over to LS 10W and LS 17W which also provides flow to this system. 3.2.8 CPH will prepare a final letter report with a summary of our findings and a Capital Improvement Plan for the system with the projects prioritized. The report will be prepared for internal use only and will be succinct in nature. The report will include the information that results from the computer model such as the projected operating conditions for each lift station in a tabular format; the recommended improvements for each lift station and the associated forcemain system; the capacity of each sub basin and the capability of each subbasin; and, a recommended capital improvement plan for the system. 3.2.9 CPH will prepare a design of the forcemain along Moss Road to the new connection point adjacent to lift station 7W. The route is approximately 2800 lineal feet and will run along Moss Road to north of the Gee Creek bridge and down along the power easement in property owned by the city or where easements already exist. We will provide a survey and design plans at a 1 inch equals 30 feet scale. SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4.1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER will furnish or obtain under subcontracts, supplementary services of the following types which will be paid for by the OWNER as additional services. 4.2.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as described herein. 4.2.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Amendment. 4.2.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. 4.2.4 Additional engineering services required by revisions to regulations (after the date of this Amendment) as applicable to the Florida Department of Environmental Protection, the St. Johns River Water Management District, or other regulatory agency requirements. 4.2.5 Provide, through a subconsultant, additional surveying services if required or requested by the OWNER. 4.2.6 Provide, through a subconsultant, soils investigation and geohydrological services if required or requested by the OWNER, or if required by SJRWMD or FDEP, recommended by the ENGINEER and authorized by the OWNER. SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 The OWNER will: 5.1.1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER'S representative with respect to the work to be performed under this Amendment, and such person shall have complete authority to transmit instructions, receive information, interpret and define the OWNER'S policies and decisions pertinent to the work covered by this Amendment. 5.1.2 Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Amendment. 5.1.3 Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information. 5.1.4 5.1.5 5.1.6 5.1.7 5.1.8 5.1.9 5.1.10 Provide personnel to locate facilities and mow, trim, or otherwise make them accessible for inspection. Examine all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as not to delay the work of the ENGINEER. Obtain approval of all governmental authorities having jurisdiction over the project, and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, soils investigations if advised in writing by the ENGINEER that they are necessary or advisable. Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, necessary additional services as stipulated in Section 4 of this Amendment, or other services as required. Provide such legal, accounting, and insurance counseling services as may be required for the project, and such auditing services as the OWNER may require. Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT 6.1 PAYMENT 6.1.1 The fee for the scope of services described herein (analysis, design and permitting) will be provided for a lump sum fee of $39,965. A breakdown by task is included in Attachment A. 6.2 REIMBURSED EXPENSES 6.2.1 The OWNER will make prompt monthly payments in response to ENGINEER'S monthly statements without retention for all categories of services rendered under this Amendment and for reimbursable expenses incurred. 6.2.2 Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.2.3 will be computed at a rate of $1000.00 per day or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed on an hourly rate). 6.2.3 If this Amendment is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 and 6.2.1 on account of that and all prior work under this Amendment shall be due and payable, and shall constitute total payment for services rendered. In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. 6.2.4 The ENGINEER shall promptly begin work on the services authorized by this Amendment upon receipt of notice to proceed from the OWNER. SECTION 7 GENERAL CONDITIONS 7.1 Since the ENGINEER has no control over the cost of labor, materials, or equipment, or over any construction contractor's method of determining prices, any opinions of probable construction cost which may be provided in the services of this Amendment are made on the basis of his experience and qualifications and represent his best judgment as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Amendment and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Amendment. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body, which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. SECTION 8 8.1 The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed. This Amendment dated j 22 , 2006, by and between the City of Winter Springs (hereinafter called the OWNER) and CPH Engineers, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Amendment to an Agreement dated November 27, 1984, between the parties, herein setting forth the scope, terms and conditions of the services herein authorized. The appropriate provisions of the Agreement apply as fully as if repeated herein. J:\Z6582\Proposals\Winter SpringsWMEND86 Lift stationforcemain analysis west side.doc SECTION 1 GENERAL 1.1 The purpose of this Amendment is to provide for Engineering Services, more specifically itemized herein, in the preparation of a SewerCad model of the western lift station system not including the Highlands area system (the excluded lift stations include 3W, 4W, 6W, 9W and 13 W). The plant lift station, 12W, will be included as it connects to the system in question. SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. 2.1.2 The ENGINEER will serve as the OWNER'S professional engineering representative in those phases of the project to which this Amendment applies, and will give consultation and advice to the OWNER during the performance of his services. The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager and Utilities Director and will submit interim plans to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the preparation of the model and analysis. 3.2 Model and Analysis 3.2.1 The City shall provide an AutoCad or electronic compatible version of the sewerage transmission system for import into the SewerCad program. This system shall also contain any known, designed or planned improvements and if not, they shall be identified by the City for inclusion in the analysis. 3.2.2 The City shall provide all pertinent data and lift station pump curves. This includes: 1) Number of pumps per station 2) Wet well diameter 3) Variable speed pumps and locations 4) Size, type and brand of each pump at each associated lift station and a pump curve for each pump 5) Forcemain and gravity system sizes. The gravity size only applies to gravity sections required for re-pump situations, such as the Town Center system to the LS10W system. For these gravity sections that receive a lift station discharge J:\Z6582\Proposals\Winter Springs\~1MEND86 Lift stationforcemain analysis west side.doc and the flow continues on to another lift station (re-pump), we need to have the invert elevations at each manhole or at least the total drop and total length from the initial discharge manhole to the lift station 6) Pump station run times 7) Pump station draw-down results 8) Float elevations at each lift station 9) Relative elevations (based on USGS datum) of the top and bottom of the lift stations (these can be obtained form record drawings and do not need to be surveyed unless the City wants that degree of accuracy) 3.2.3 The City shall provide the average annual daily per capita flow and the average persons per household or the average daily flow per customer/connection. 3.2.4 The City shall identify and provide the lift station basin areas. 3.2.5 The City shall provide the number of single family and multi family units and commercial flows in each lift station basin. 3.2.6 CPH will prepare a model using SewerCad using the data obtained from the above items. Run a 24 hour simulation of the system and verify with the City that the model mimics the actual system. Analysis will include and evaluation of future conditions with information provided by the city. 3.2.7 CPH will analyze the extension of the forcemain from LS 10W, 5W and 11 W and the elimination of the gravity section on Moss Road. Within this scenario is the assumption that lift stations 10W, 5W and 11 W will pump sewage directly to the West WRF and that the forcemain will be extended to the west side of LS 7W. We will provide the City with the system capital improvements necessary to meet these conditions. We will also analyze any weaknesses in the existing systems and advise the City if we believe that any additional capacity is available within the system. Of particular interest is the Town Center/High School system which pumps over to LS 10W and LS 17W which also provides flow to this system. 3.2.8 CPH will prepare a final letter report with a summary of our findings and a Capital Improvement Plan for the system with the projects prioritized. The report will be prepared for internal use only and will be succinct in nature. The report will include the information that results from the computer model such as the projected operating conditions for each lift station in a tabular format; the recommended improvements for each lift station and the associated forcemain system; the capacity of each sub basin and the capability of each subbasin; and, a recommended capital improvement plan for the system. 3.2.9 CPH will prepare a design of the forcemain along Moss Road to the new connection point adjacent to lift station 7W. The route is approximately 2800 lineal feet and will run along Moss Road to north of the Gee Creek bridge and down along the power easement in property owned by the city or where easements already exist. We will provide a survey and design plans at a 1 inch equals 30 feet scale. J:\Z6~82\Proposals\Winter Springs\AMEND86 Lift sta[ionforcemain analysis west side.doc SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4.1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER will furnish or obtain under subcontracts, supplementary services of the following types which will be paid for by the OWNER as additional services. 4.2.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as described herein. 4.2.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Amendment. 4.2.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. 4.2.4 Additional engineering services required by revisions to regulations (afterthe date of this Amendment) as applicable to the Florida Department of Environmental Protection, the St. Johns River Water Management District, or other regulatory agency requirements. 4.2.5 Provide, through a subconsultant, additional surveying services if required or requested by the OWNER. 4.2.6 Provide, through a subconsultant, soils investigation and geohydrological services if required or requested by the OWNER, or if required by SJRWMD or FDEP, recommended by the ENGINEER and authorized by the OWNER. SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 The OWNER will: 5.1.1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER'S representative with respect to the work to be performed under this Amendment, and such person shall have complete authority to transmit instructions, receive information, interpret and define the OWNER'S policies and decisions pertinent to the work covered by this Amendment. 5.1.2 Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Amendment. 5.1.3 Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information. 5.1.4 Provide personnel to locate facilities and mow, trim, or otherwise make them accessible for inspection. J:\Z6582\Proposals\Winter Springs\AMEND86 Lift stationforcemain analysis west side.doc 5.1.5 Examine all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as not to delay the work of the ENGINEER. 5.1.6 Obtain approval of all governmental authorities having jurisdiction over the project, and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. 5.1.7 Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, soils investigations if advised in writing by the ENGINEER that they are necessary or advisable. 5.1.8 Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, necessary additional services as stipulated in Section 4 of this Amendment, or other services as required. 5.1.9 Provide such legal, accounting, and insurance counseling services as may be required for the project, and such auditing services as the OWNER may require. 5.1.10 Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT 6.1 PAYMENT 6.1.1 The fee for the scope of services described herein (analysis, design and permitting) will be provided for a lump sum fee of $39,965. A breakdown by task is included in Attachment A. 6.2 REIMBURSED EXPENSES 6.2.1 The OWNER will make prompt monthly payments in response to ENGINEER'S monthly statements without retention for all categories of services rendered under this Amendment and for reimbursable expenses incurred. 6.2.2 Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.2.3 will be computed at a rate of $1000.00 per day or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed on an hourly rate). 6.2.3 If this Amendment is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 and 6.2.1 on account of that and all prior work under this Amendment shall be due and payable, and shall constitute total payment for services rendered. In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. SECTION 7 ' GENERAL CONDITIONS 7.1 Since the ENGINEER has no control over the cost of labor, materials, or equipment, or over any construction contractor's method of determining prices, any opinions of probable construction cost which maybe provided in the services of this Amendment are made on the basis of his experience and qualifications and represent his best judgment as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Amendment and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Amendment. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body, which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. SECTION 8 8.1 The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed.
