HomeMy WebLinkAbout2018 11 19 Consent 301 Tuskawilla Crossings - Phase 1 Site AcceptanceCOMMISSION AGENDA ITEM 301 November 19, 2018 Regular Meeting REQUEST: Informational Consent X Public Hearings Regular KS City Manager Department The Community Development Department requesting the City Commission validate the Staff recommendation finding the sitework for the Phase 1 portion of Tuskawilla Crossings to be built in substantial accordance with the Final Engineering plans, subject to the enclosed punchlist. SYNOPSIS: Sitework for the Phase 1 portion of Tuskawilla Crossings project is substantially complete and has been conditionally approved by the applicable City Departments. This agenda item provides the site acceptance necessary before a certificate of occupancy can be issued by the Building Official. CONSIDERATIONS: APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. Consent 301 PAGE 1 OF 2 - November 19, 2018 SUMMARY: The Tuskawilla Crossings project consists of a 379 -unit single family residential subdivision by Lennar Homes. The project is located southeast of SR 434 and Tuskawilla Road. The project area is approximately 133 acres and includes a central amenity area and a commercial outparcel. The final engineering plans were approved by the City Commission at the April 24, 2017 City Commission meeting. The Developer's Agreement was approved on April 24, 2017, and the First Modification of Developer's Agreement was approved on August 13, 2018. Sitework began April 28, 2017. This agenda item is for the conditional acceptance of the Phase 1 (Exhibit B) site improvements. The sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached punchlist, Exhibit A. All items on the punchlist must be complete, subject to staff approval, prior to issuance of the certificate of occupancy. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Phase 1 portion of the Tuskawilla Crossings sitework to be built in substantial accordance with the Final Engineering plans, subject to satisfactory completion of the remaining open punchlist items. Complete all sitework and pass the final engineering inspection. Contact Bryant Smith, P.E. at 407-327-8979 to schedule a preliminary and/or final engineering inspection. The final inspection will occur after receipt of the record drawings from the engineer -of - record. 2. Submit a Bill of Sale for all infrastructure being turned over to the City for ownership and maintenance (streets, utilities, sidewalks, etc.). Use the City's standard Bill of Sale form. 3. Submit 2 -Year Maintenance Bond, Letter of Credit, or Cash Escrow Deposit (10% of the value of the improvements to be owned and maintained by the City, as listed on the Bill of Sale) 4. Obtain Approvals from all City Departments and Seminole County Fire Department 5. Submit FDOT Permit Certification and provide City copy of FDOT approval 6. Submit a copy of the FDEP Wastewater Permit Approvals to the City. Notes: • City Commission site acceptance (in the form of a consent agenda item at a regularly scheduled City Commission meeting) is required before a certificate of occupancy can be issued for any buildings • Agenda items for City Commission meetings must be prepared approximately two weeks prior to the meeting date. • If there are any questions, please call Bryant Smith, P.E. at 407-327-8979 Additional items to be completed prior to closeout (this is not a complete punchlist): • Final lift of asphalt • Final striping • Complete signage installation • Complete stormwater pond grading • Complete lift station and enclosure • Complete street lighting installation • Site cleanup • Repair damaged curb and sidewalks
