SYNOPSIS: Northern Oaks is a proposed 35 -lot single- family residential subdivision on 20.48 acres located 'east of the intersection of State Road 434 and State Road 417. The applicant, Madichristo Land Holdings, LLC, is requesting approval of the Final Engineering Plans and a waiver request for the side and rear setbacks. City Liens if any): No known City liens APPLICABLE LAW &, PUBLIC POLICY, AND EVENTS City of Winter Springs Comprehensive Plan City of Winter Springs Code of Ordinances, Chapter 9, Land Development CHRONOLOGY *February 22, 2016 — City Commission approval of the Northern Oaks Annexation, Large -Scale future land use amendment, and rezoning to Low Density Residential and R -IA (One - family dwelling). Final Engineering Plans Northern Oaks is a proposed single - family residential subdivision located east of the intersection of State Road 434 and State Road 417. The proposed subdivision consists of 35 lots on 20.48 acres of land. The subject property is zoned R -1 (One - family dwelling district). The applicant is proposing a minimum lot size of 7,800 square feet and a minimum lot width of 60 feet, in accordance with Section 20 -185 of the City Code. A wall will be installed in an easement along the rear portions of all lots along the southern portion of the development, fronting SR 434. The adjacent property to the west is zoned Seminole County Agriculture (A -1) and the vacant property to the east is zoned Neighborhood Commercial (C -1). The property located at the southwestern boundary, also known as the Hendrix property, has been excluded from the Final Engineering Plans and has not been annexed into the City of Winter Springs. The subdivision is proposed to be gated with private streets. Vehicular access to the site will be via a private street accessed directly off of S.R. 434. The private street proposed through the subdivision will terminate on proposed cul -de -sacs at the east and west ends. Internal streets will consist of 50 -foot of rights -of -way with 24 -feet pavement width. Five foot wide sidewalks will be installed on both sides of the street. Additionally, there will be a 0.62 acre tract that fronts on SR 434, labeled Tract C. Tract C is reserved for future FDOT right -of -way dedication, in the event that SR 434 is widened. An Aesthetic Review package has not been submitted at this time. The Aesthetic Review package will be submitted after the developer, Madichristo Land Holdings, LLC, reaches an agreement with a homebuilding company. The Aesthetic Review will require City Commission approval at a future meeting date to be determined. Waiver Request: The applicant is requesting two waivers. The waiver requests are to Section 20- 186 Front, rear, and side yard regulations, more specifically the side and rear yard setback requirements. The property is zoned R -1 and meets the building site requirements established by Section 20 -185 of the City Code. The minimum lot width is 60 feet and the Public Hearings 401 PAGE 2 OF 4 - March 13, 2017 minimum lot size proposed is 7800 square feet, which exceeds the Code required 6,600 square feet. The applicant is seeking relief for the required side and rear yard setbacks to accommodate a potential home builder. The waiver request is similar to other areas in the City such as the Tuscawilla PUD. Waiver Description City Code Requirement Proposed Waiver Request 1. Rear Yard Setback 25 feet 20 feet Section 20 -186 (2) 2. Side Yard Setback 6 feet 5 feet Section 20 -186 3 Any real property owner may file a waiver application requesting a waiver for their real property from any term and condition of this chapter (except from the list of permitted, conditional and prohibited uses set forth in any zoning district category) if the property owner clearly demonstrates that the applicable term or condition clearly creates an illogical, impossible, impractical, or patently unreasonable result. The Planning and Zoning Board reviewed the waiver applications at their March 1, 2017 meeting and forwarded a recommendation of approval to the City Commission. The six waiver criteria set forth in Subsection 20 -34 (d) are as follows: 1. The proposed development plan is in substantial compliance with this chapter and in compliance with the comprehensive plan. 2. The proposed development plan will significantly enhance the real property. 3. The proposed development plan serves the public health, safety, and welfare. 4. The waiver will not diminish property values in or alter the essential character of the surrounding neighborhood. 5. The waiver granted is the minimum waiver that will eliminate or reduce the illogical, impractical, or patently unreasonable result caused by the applicable term or condition under this chapter. 6. The proposed development plan is compatible with the surrounding neighborhood. In evaluation of the two proposed waiver requests, Staff has concluded that the request satisfies the six specific criteria required for Waivers in the City Code of Ordinances. FISCAL IMPACT: Approval of the Final Engineering Plan and Aesthetic Review allows the subject property to be developed into a single - family residential subdivision. Development of the subject property is anticipated to provide an increase to the City's taxable value. The potential tax revenue of the proposed project is as follows: Public Hearings 401 PAGE 3 OF 4 - March 13, 2017 • Fee Simple Single Family Residential Units - 35 units • Units - 35 assessed at $200,000 = $7,000,000 assessed tax value o $10,800,000/1000 =7,000 o $7,000.00x(2.4300)=$17,010 o $17,010 (less the 4% statutory discount) = $16,329.60 tax revenue COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server.
