RESOLUTION NO. 518
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
UNANIMOUSLY OPPOSING A DECISION OF THE COUNTY GRANTING
ANY APPROVAL FOR THIS SITE FOR HAZARDOUS WASTE CONSULTANTS,
INC.; APPEALING THE DECISION OF THE BOARD OF ADJUSTMENT OF
SEMINOLE COUNTY ALLOWING HAZARDOUS WASTE CONSULTANTS, INC.
TO LOCATE ON THIS SITE; CONFLICTS AND EFFECTIVE DATE.
WHEREAS the Seminole County Board of Adjustment granted a
special exception for Hazardous Waste Consultants, Inc. to lease two acres
between S. R. 419 and Old Sanford-Oviedo Road to park trailers loaded with
wastes destined for disposal outside the county and State; and
WHEREAS this site is surrounded by the City of Winter Springs;
and
WHEREAS, this site being on a private road with no fire flow, and the
City of Winter Springs not having a first response agreement with Seminole County;
and
WHEREAS, this area is abutting Spring Hammock and soldiers Creek, a
water recharge area, with the possibilities of destruction to surface and ground
water tables and other environmental dangers; and
WHEREAS, a large percentage of the populace of the City of Winter
Springs either work or reside in this area, such as: Winter Springs Elementary
School, The Grove Counseling Center, the Evangelical Congregational Church,
Meadowlark, The Highlands, and LaPetite Academy; and
WHEREAS, this area is known for hazardous lightning flashes and
WHEREAS, there is a threat to the wildlife in the area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA:
SECTION I - That the City Commission unanimously opposes the decision
of the County Board of Adjustment to grant any approval for Hazardous Waste
Consultants, Inc. to locate a facility on this site for the safety, health and
welfare of the citizens of Winter Springs, Florida.
SECTION II - The City Commission hereby appeals the decision of the
Board of Adjustment of Seminole County allowing Hazardous Waste Consultants, Inc.
to locate on this site.
SECTION III - The City of Winter Springs is hereby jointly and
severally aggrieved by the actions of the Seminole County Board of Adjustment
in regard to the granting of a special exception for Hazardous Waste Consultants,
Inc. to utilize lands abutting the City of Winter Springs for a toxic waste
chemical transfer station.
SECTION IV - All resolutions or parts of resolutions in conflict with
this resolution are hereby repealed.
SECTION V - This resolution shall take immediate effect upon its
passage and approval.
