HomeMy WebLinkAboutResolution 237 Municipal Boundaries RESOLUTION # 237 WHEREAS, the City Council of the City of Winter Springs, Florida has introduced Ordinance #179 contracting the boundaries of the City of Winter Springs, Florida. WHEREAS, the City Council of the City of Winter Springs, Florida has indicated a desire for a referendum on the question of contraction. WHEREAS, certain matters must be resolved in order to proceed with the contraction process in accordance with Section 171.051. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF WINTER SPRINGS, FLORIDA: 1. After public hearing, the City Council finds that the total area proposed for contraction was not contiguous to the City of Winter Springs boundaries at the time that these contraction proceedings were begun. 2. After public hearing, the City Council finds that the area proposed for contraction has not been developed for urban purposes in accordance with F.S. 171.043 (2) nor is it a necessary land connection connecting the city and areas developed for urban purposes in accordance with F.S. 171.043 (3). 3. The City Council confirms its call for and acknowledges that it has scheduled and noticed a referendum for November 7, 1978 to determine the question of contraction as presented by proposed Ordinance #179. 4. In the event that a majority of the qualified voters vote for deannexation, the mayor with such staff as is necessary is directed to negotiate an agreement with Seminole County defining the indebtedness or property to be assumed by the County . 5. If there are any qualified voters residing in the area affected by proposed Ordinance #179 who are not residents of Precinct 50 and whd have registered to vote, such voters will be provided paper ballots to allow for them to vote on the issue of contraction. The City Clerk is to coordinate such a paper ballot with the Supervisor of Elections. PASSED and ADOPTED this 31st day of October, 1978. CITY OF WINTER SPRINGS, FLORIDA By: Troy J.
