BERRIEN CLERK OF CIRCUIT COURT SEMINOLE COUNTY, FL RECORDED & VERIFIED 1987 Jan 16 PM 4 44 ORDINANCE NO. 361 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING THE COMPREHENSIVE PLAN IN ACCORDANCE WITH FLORIDA STATUTES 163.3187; PROVIDING FOR THE ADDITION OF ANNEXED PROPERTY TO THE LAND USE MAP AT COMMERCIAL AND LIGHT INDUSTRIAL CLASSIFICATIONS; PROVIDING FOR THE ZONING CATEGORY C-l AND C-2 FOR THE PROPERTY ON THE OFFICIAL ZONING MAP; SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE. WHEREAS the City of Winter Springs has annexed the property described below, upon petition of the owner, Lewis and Juanita D. Blumberg: Lots 29, 30 and the West portion of un-numbered lot, Block B, D.R.Mitchell's Survey of the Levy Grant, Plat Book 1, Page 5, Public Records of Seminole County, Florida. WHEREAS, the owner of the property wishes to use the property in a manner consistent with the zoning category C-2 of the City of Winter Springs west portion of for Lots 29 and 30, Block B, and the zoning category C-l for the unnumbered Lot, Block B, D. R. Mitchell's Survey of the Levy Grant; and WHEREAS the annexed property must carry the land use classifica- tion Light Industrial to allow for said zoning category C-2 and the land use classification Commercial to allow for zoning category C-l; and WHEREAS the City of Winter Springs, Florida, has considered the assignment of the Light Industrial and Commercial land use classifications for the said properties on the Land Use Nap of the City in accordance with Florida Statute 163.3187 and has determined that the addition of the properties to the Land Use Map as Light Industrial and Commercial, respectively, is consistent with the Comprehensive Plan of the City of Winter Springs, Florida. NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF TIlE CITY OF WINTER SPRINGS, FLORIDA, THAT: SECTION I. The Comprehensive Plan of the City of Winter Springs, Florida, is hereby amended to add to the Land Use Map the property described below and to assign to it the land use classification Light Industrial: Lots 29 and 30, Block B, D. R. Mitchell's Survey of the Levy Grant, P.B. 1, Page 5, Seminole County. SECTION II. The property is hereby zoned C-2 General Commercial and Industrial and shall be so specified on the Official Zoning Map of the City of Winter Springs, Florida. SECTION III. The Comprehensive Plan of the City of Winter Springs, Florida, is hereby amended to add to the Land Use Map the property described below and to assign to it the land use classification Commercial: West portion of Unnumbered lot, Block B, D. R. Mitchell's Survey of the Levy Grant, P.B. 1, Page 5, Seminole County. SECTION IV. The property is hereby zoned C-l Neighborhood Commercial and shall be so specified on the Official Zoning Map of the City of Winter Springs, Florida. SECTION V. If any section or portion of this Ordinance proves to be invalid, unlawful or unconstituional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or sub-section or part of this Ordinance. SECTION VI. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION VII. This Ordinance shall take effect immediately upon its final passage and adoption.
